“Anti-racist” isn’t an identity, it’s actions. It’s doing the work of deconstructing the systems of racism we were all raised in. Systems that harm us all. It’s not about being a “good person” or not being called “racist”, it’s about genuinely interacting with the world to make it better. And yeah, we’re going to make mistakes while we do it. We’re going to blow it and get embarrassed, but that doesn’t mean we should stop trying. Ultimately, it’s not about us. It’s about living and growing in a society where Diversity, Equity and Inclusion aren’t just a department, but a way of life. The crisis in the Middle East, like so many issues that truly matter, is complicated and nuanced and simply won’t fit on a bumper sticker. It’s essential that we look at the whole picture and move beyond who needs to be punished (and many do) to set a goal of creating a place of peace and stability. This is also not an isolated issue. Governments around the world are shifting to the far right and supporting each other as they do it. So, whether it’s Putin, Netanyahu, Hamas or Trump, they’re all looking out for number one, and we need to be supporting alternatives who want everyone to succeed, not simply the select few. At the end of the day we need to hold two ideas in our heads at once. Palestinian people deserve a state of their own, without Israeli occupation, and Israel deserves to exist in safety and security in the midst of a hostile region. It’s an incredibly difficult needle to thread, but a peaceful coexistence is what anyone who believes in the rights of humanity should want. It’s hard not to be cynical about American politics and the American experiment with all that’s going on, but the truth of the matter is we have tremendous leadership right now. The country is doing extremely well. Legislation that became law over the past two years is set to become tangible reality in the next two. Yes, we are looking at an increasingly undemocratic Republican Party who can’t even compromise with itself long enough to get their speaker elected, but we’re also looking at competent, fresh new leadership to counter them, along with new factories, new jobs, new infrastructure. We’re looking at lower drug prices and major corporations paying taxes for the first time. We’re going to have universal broadband for all our citizens, gun legislation and climate protections. The majority of youth in America are not on board for the new extremist Republican agenda. They believe in reproductive rights, and that the climate is in crisis. At their peak, 40% of American workers were part of a union, now that number is under 7%, and look what’s happened - the rich got richer while the poor got poorer and the middle class has all but disappeared. People can’t afford homes, food or health care, and the majority of us have to take a side hustle or gig work on top of our regular jobs just to make ends meet. It’s unsustainable, and the workers of America are beginning to stand in solidarity against it. We know the conservative movement wants to return us to “a better time”, what they see as the “natural order”, with the white, straight Christian man on top, but even those who see themselves as liberal or centrist can struggle with the idea of changing the status quo, because it feels like a potential losing proposition for people who have always been at the top. That people who would be outwardly opposed to MAGA still feel uncomfortable with all these calls for equality and respect, especially when it’s perceived to question their judgment, or status in society. Christian nationalists believe that America is defined by Christianity, and the government should be taking active steps to keep it that way. This is completely antithetical to how our nation was actually set up, but they now have their hands in so many pots - from education, to voting, to human rights - and are backed by such an large amount of dark money, with seemingly endless connections, that the bottom line is if we don’t wake up to the danger of this movement, which in many ways runs parallel with the white nationalist moment and, these days MAGA Republicans, then we’re going to wake up in the near future to realized we live in some version of a Christian autocratic theocracy where our laws, lifestyles, even our morality is dictated by a select few, and the only choices we’ll have left will be conform or suffer. A couple weeks ago we did a pod on Florida and the chaos DeSantis is inflicting on his state. You only have to look around the country right now to see the power state legislatures have over almost every part of our lives. While the 10th Amendment is a check on the power of the federal government, it gives state leadership an almost infinite amount of power, and in the wrong hands, this unchecked influence has been an absolute disaster for human rights, civil rights and democracy. For 40 years, while Republicans invested billions of dollars and focused energy into building and holding state governing majorities Democrats focused the majority of their attention and money on national races and, while it seemed like things were progressing around the country, individual states were actually putting the pieces in place for regressive laws that would take us back. Two years ago I did a rant about how the Republicans were beta testing fascism in Florida. I compared Ron DeSantis to one of those raptors in Jurassic Park. The Wisconsin Supreme Court election on April 4th is THE most important election of 2023. It’s hard not to be cynical about American politics and the American experiment with all that’s going on, but the truth of the matter is we have tremendous leadership right now. The country is doing extremely well. Legislation that became law over the past two years is set to become tangible reality in the next two. Yes, we are looking at an increasingly undemocratic Republican Party who can’t even compromise with itself long enough to get their speaker elected, but we’re also looking at competent, fresh new leadership to counter them, along with new factories, new jobs, new infrastructure. We’re looking at lower drug prices and major corporations paying taxes for the first time. We’re going to have universal broadband for all our citizens, gun legislation and climate protections. This is our last episode before the break, and I can’t imagine closing out the year without a dedicated conversation about democracy, so today’s pod is a Candid Conversation with democracy’s super lawyer Marc Elias. Marc is an American Democratic Party elections lawyer who served as general counsel for the Hillary Clinton and John Kerry presidential campaigns, and is the founder of the Elias Law Group who oversaw the state by state response to the 60+ Trump campaign lawsuits contesting the 2020 presidential election, where he won all but one minor case, which was later overturned in his favor. It is Marc and the Elias Group who, as the Republicans and their allies turn their attention to using litigation as a weapon against democracy, have been at the front line fighting back. Ron Klain joins us for the post-midterm wrap up. Though not all the results are in, we do know that Democrats will hold the Senate, no election deniers will be in charge of elections, that Democrats have gained governorships and made headway in state houses and the power of hate and division might be on the wain. However, it shakes out, the midterms were a good day for democracy. We might be in for a contentious 2 years, but then again, aren’t we used to that by now? The bottom line is people took this election as their opportunity to register their distaste for extremism, election denialism and political violence. They came out to vote for human rights and bodily autonomy and a properly functioning government. If the country is sick, these elections feels a bit like a fever break. Are we out of the woods? When we last had Teri Kanefield on the show she was reminding us that just because we weren’t seeing the results we wanted didn’t mean the wheels of justice weren’t turning. People wanted so badly for the DOJ to tell us they were investigating Trump, for Trump to be arrested, for RESULTS, but Teri has always believed that the fact that we were seeing so little, was good news for the health of the rule of law. She’s always stressed how important it is to not rush the process or abandon the rules simply because we wanted to. That one party has made it very clear they’re ready to abandon democracy and the rule of law and Teri has been equally clear we shouldn’t help them do that by abandoning the rule of law ourselves. 5 months later, after the search of Mar-a-lago we can see she was right when so many others were wrong. Want to understand what’s going on right now? America is at a crossroad. There is a real possibility that we will cease to have democracy in the United States. As Rothkopf says, “Republicans don’t just want to repeat the “Big Lie”, they want to repeat the ability to do what Trump WANTED to do and disenfranchise the American people.” Holding Trump accountable is essential, but almost more important, is defeating anyone who would undermine the integrity of our elections for their own power. We have to recognize that the majority of the country doesn’t believe this “noxious right wing cocktail of lies” but it’s up to us to make sure those who do, aren’t the ones making the decisions. In less than a year Governor Hochul has gone from Governor by default, after the abrupt resignation of Governor Andrew Cuomo, to leading gubernatorial candidate for New York’s November’s election. Born and bred in upper New York State, Governor Hochul is lawyer, a mother and lifetime public servant, Governor Hochul is also a tireless advocate for women’s rights and women in leadership. She stepped up to the plate when opportunity called, and she’s a big proponent of more women feeling the confidence to do the same. Governor Hochul makes the argument that Democrats must, and can, protect our majority in government and that we need to reach out to anyone who believes in democracy and the American experiment to fight for values that are currently under attack. Governor Hochul really seems to be the real deal. A leader who believes in listening, collaboration and learning from others. She’s also not afraid to get scrappy if the moment calls for it. Russia’s invasion of Ukraine is not some standalone crisis that started in late February, but rather a much bigger picture that’s coming together. The right to vote in America is under attack. The Republicans, and the dark moneyed powers who fund them, have made a calculated decision to rig the elections in their favor to regain and retain power. Based on the recent powerpoint presentation, text messages and correspondence that Donald Trump’s Chief of Staff, Mark Meadows, released to the January 6th Bipartisan Select Committee, we can now see, beyond a shadow of a doubt, that the 45th President of the United States, in collusion with his team and current sitting members of Congress deliberately attempted to overthrow the Government of the United States and end American Democracy as we know it. It is a frustrating time. Most of us are losing our minds with the lack of accountability for Trump & Co. We’re mad at the Democrats for not moving faster and doing more. We’re mad at the DOJ for seemingly doing nothing. We’re mad that it feels like we’re the only ones calling for justice and we want results like, yesterday. But, as Teri Kanefield says, “It’s important we don’t fight autocracy with autocracy” because “if we fight like them, we will end up like them” and then our democracy will be well and truly gone. People need to channel their anxiety into productive action. At the end of the day, there is no magic bullet. The only way to save democracy is with more democracy. Enough of the spin, the depressing headlines & the bad poll numbers. By almost every discernible metric, the Democrats are actually doing incredibly well.  We talk about the signed bipartisan Infrastructure Bill, the biggest investment in our country in over 50 years; the Build Back Better Act, that could be the greatest social spending bill in decades; and, we talk in depth about the party that voted AGAINST all of that because they’ve chosen Democratic failure over American success. We question who the Republican Party has become as they’re no longer attempting to govern, but setting up to rule, and based on which voices they’re abandoning and which they’re elevating, it appears the future under the GOP will look a lot more like Hungary than America.
